These terms govern your use of tribeandtrowel.com and everything you buy from us. By placing an order or using the site, you agree to them.

Tribe & Trowel is operated from 212 SW 9th Street, Fort Lauderdale, FL 33315, United States. "We," "us," and "our" mean Tribe & Trowel. "You" means you.

1. Using this site

You must be at least 18, or have permission from a parent or guardian, to buy from us. You agree not to use the site for any unlawful purpose, not to attempt to interfere with it or gain unauthorised access, and not to scrape or copy it at scale.

2. Products, descriptions, and prices

We try hard to describe our products accurately, including photographs. Seeds are natural products and there is normal variation in size, colour, and appearance between packets and between growing seasons.

Prices are in US dollars and may change without notice. We make every effort to keep prices and product information correct, but errors happen. If a product is listed at an incorrect price, we reserve the right to cancel the order and refund you in full, whether or not the order has been confirmed.

We may discontinue any product at any time, and we may limit the quantity of any product we sell to one person or household.

3. Orders

Your order is an offer to buy. We accept it when we send you a shipping confirmation. We may refuse or cancel any order at our discretion — for example if we suspect fraud, if a product is out of stock, or if there's been a pricing error. If we cancel an order you've already paid for, we refund you in full.

4. Payment

Payment is taken at checkout. We accept the payment methods shown at checkout. By providing payment details you confirm you're authorised to use that payment method.

5. Shipping and returns

Shipping terms are set out in our Shipping Policy. Refunds, returns, and our guarantees are set out in our Refund Policy. Both are incorporated into these terms.

6. Digital products — licence and restrictions

When you buy an ebook, field guide, course, planner, or any other digital product, you are buying a personal, non-transferable licence to use it — you are not buying the copyright.

You may: read it, print a copy for your own use, and use what you learn however you like, including commercially in your own garden or farm.

You may not: resell it, share it, upload it to a file-sharing service, distribute it to a group, or reproduce it for anyone else. Course access is for one person and may not be shared.

We may revoke access to digital products if these restrictions are breached.

7. The Tribe membership

Membership in The Tribe is billed annually in advance.

Automatic renewal. Your membership renews automatically each year, and your payment method is charged the then-current renewal rate, unless you cancel first. Founding members keep their founding rate for as long as their membership remains continuously active. You may cancel at any time from your account or by emailing support@tribeandtrowel.com. Cancelling stops future renewals; it does not refund the current term except as set out below.

60-Day Membership Guarantee. If you cancel within 60 days of joining, you get a full refund of your membership fee and you keep the welcome kit.

Member benefits — including member pricing, seed drops, early access, and free shipping — are provided as long as your membership is active and may change over time. We'll tell members before making a material change.

8. Growing results — important

Gardening depends on many things we do not control: your soil, climate, weather, water, timing, sowing depth, pests, and how the seed is stored after it reaches you.

Our Sprout No Doubt Guarantee covers germination — if your seeds don't sprout in the guarantee window, we refund or replace them, as set out in the Refund Policy. That guarantee is the full extent of what we promise about growing.

We do not guarantee any particular yield, harvest size, food output, or growing outcome, and nothing in our marketing, guides, courses, or videos should be read as such a promise. Information we publish is general educational guidance, not agricultural, nutritional, medical, or financial advice for your specific situation.

Any statement about the value of food a garden might produce, or the money it might save, is an illustration based on general assumptions — not a prediction of your results.

9. Herbs, plants, and health

Some varieties we sell have traditional culinary or herbal uses. Any such information we provide is historical and educational only. It is not medical advice, and nothing we sell is intended to diagnose, treat, cure, or prevent any disease. Talk to a qualified healthcare professional before using any plant medicinally, particularly if you are pregnant, nursing, or taking medication. Never eat a plant you have not positively identified.

10. Delivery area and state seed regulations

We ship physical products to the 48 contiguous United States and the District of Columbia only. We do not ship seed to Alaska, Hawaii, US territories, APO/FPO addresses, or internationally. Digital products remain available worldwide. See our Shipping Policy for the full detail.

A small number of US states restrict certain plant species. It is your responsibility to know and comply with the seed, plant, and agricultural regulations that apply where you live, including any rules about growing particular species.

11. Intellectual property

Everything on this site — text, photographs, illustrations, logos, guides, course material, and the Tribe & Trowel name and brand — is owned by us or licensed to us and protected by copyright and trademark law. You may not use it without our written permission, other than as permitted by the digital product licence in section 6.

12. Reviews and customer content

If you submit a review, photo, comment, or other content, you keep ownership of it but grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce it in connection with our business, including in marketing.

You confirm that any content you submit is your own honest opinion and your own work, and that you have not been paid by anyone else to post it. We may remove any content at our discretion. We do not publish fake, incentivised, or fabricated reviews, and we do not edit reviews to change their meaning.

13. Third-party links and services

Our site may link to third-party sites and services we don't control. We're not responsible for their content, products, or privacy practices. Your dealings with them are between you and them.

14. Disclaimer of warranties

Except for the guarantees we expressly give in our Refund Policy and these terms, and to the fullest extent permitted by law, the site and our products are provided "as is" without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

15. Limitation of liability

To the fullest extent permitted by law, our total liability to you for any claim arising out of your purchase or use of the site is limited to the amount you paid us for the product in question.

We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost crops, or lost time.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. If you are a consumer, these terms do not affect your statutory rights.

16. Indemnity

You agree to indemnify us against claims arising from your breach of these terms or your misuse of the site.

17. Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction. If you are a consumer resident elsewhere, you may also have the right to bring proceedings in your own country's courts.

18. Changes to these terms

We may update these terms. The "last updated" date at the top reflects the current version, and the version in force when you place an order is the one that applies to that order. Continuing to use the site after a change means you accept the updated terms.
